MOOD.ai Terms of Use

Welcome to MOOD.ai. These Terms of Use (“Terms”) govern your access to and use of the MOOD.ai app and website (collectively, “MOOD.ai”), operated by Mood Platforms Pty Ltd (“we,” “us,” or “our”).

By downloading MOOD.ai from the App Store or Google Play, creating an account, or receiving access through your employer, you agree to be bound by these Terms. If you do not agree, please do not use MOOD.ai.


1. Who Can Use MOOD.ai

MOOD.ai is designed for individuals aged 16 and over. By using the platform, you confirm that:

  • You are legally old enough to use the app in your jurisdiction, and
  • You have the authority to agree to these Terms, either on your own behalf or as an authorised employee when your access is provided by your employer.

2. Plans and Pricing

MOOD.ai is free to download. Basic features are available at no cost. For advanced features, you may upgrade to MOOD.ai Pro:

  • $14.99 AUD per user/month
  • $149.99 AUD per user/year
  • Discounted enterprise rates available on request

If you purchase a subscription directly and later receive access through your employer, your original subscription remains non-refundable.

No refunds are provided for MOOD.ai Pro under any circumstances.


3. User Roles

MOOD.ai includes three types of users:

  • Employees – can track their mood, interact with the AI, and view personal reflections. Employees may access MOOD.ai either by downloading the app independently or by being invited through their employer. If your access is provided by your employer and you prefer not to participate, you can opt out at any time by contacting your people team.
  • Managers – can view anonymised team insights (e.g., average sentiment scores, psychological safety indicators).
  • Admins – typically HR or executive leaders who can view aggregated, anonymised organisational insights across teams and time.

At no point can any user — including managers or admins — access personally identifiable information or individual reflections.


4. Privacy and Data Use

Your emotional wellbeing is private, and we treat it that way.

  • When you download MOOD.ai independently (via the App Store or Google Play): We do not collect your name, email, or any personally identifiable data. Your use of the app is entirely anonymous.
  • When your employer provides access: Your employer may supply your name and email to create and manage your account. These identifiers are used solely for account setup, login, and ongoing access. They are not linked to your mood check-ins, chats, or reflections.

Regardless of how you access MOOD.ai:

  • Chats stay private – we do not store your chat conversations on our servers. Chats are processed in real time using the OpenAI API to generate responses. While we do not retain this data, OpenAI may process or temporarily store inputs to improve its services in line with its own policies. You can read OpenAI’s terms and privacy commitments here.
  • Check-ins are anonymous – visible only in aggregated insights when at least five people are in a group.
  • Admins see patterns, not people – wellbeing data cannot be traced back to individual employees.

Deleting the app deletes your personal data from your device. If your account was created by your employer, they may retain only the limited identifiers originally supplied for access (e.g., your work email) for compliance or record-keeping purposes.

We comply with GDPR, Australian Privacy Principles (APP), and CCPA.

Employee Rights:

If your access is provided by your employer, you always have the right to:

  • Opt out of using MOOD.ai by contacting your people team.
  • Request that your employer remove your account details (name and email).
  • Continue to use MOOD.ai independently by downloading it directly from the App Store or Google Play if you prefer.

5. How Insights Work

If your organisation funds your MOOD.ai Pro access, you may be invited to view Company Insights. Once you opt in, you become an “active user.” Insights are:

  • Based on your mood check-ins and psychological safety inputs
  • Fully anonymised
  • Visible only when five or more users exist in the same team or location

Your private chats are never shared.


6. Conduct and Safety

MOOD.ai is a space for reflection and wellbeing. It is not a clinical service.

  • There are no filters or content restrictions.
  • You may flag inappropriate AI responses.
  • Any references to self-harm or distress will prompt support resources.

If you are in crisis, please contact a qualified mental health service or emergency support provider immediately.


7. Hosting and Third-Party Tools

MOOD.ai relies on trusted third-party providers to deliver a secure and reliable service:

  • Netlify – used to host the MOOD.ai web platform and APIs.
  • Supabase – used to securely store limited account information (e.g., employer-supplied identifiers such as name and email) and anonymised check-in data.
  • OpenAI – used to generate chatbot responses in real time. We do not store chat data on our servers; however, OpenAI may process or temporarily store inputs in accordance with its own policies, available here.

We select third-party providers with strong security practices and limit data sharing strictly to what is necessary for MOOD.ai to function.


8. Intellectual Property

All content, features, and insights within MOOD.ai are the exclusive property of Mood Platforms Pty Ltd.

You may not copy, reproduce, modify, distribute, or reverse-engineer any part of MOOD.ai without prior written permission.


9. Disclaimers

  • MOOD.ai is not a medical service, diagnostic tool, or replacement for professional care.
  • It is not suitable for emergencies — please contact a crisis service if urgent assistance is required.
  • Organisational insights are general, anonymised, and non-diagnostic.

10. Termination and Data Deletion

You may stop using MOOD.ai at any time by uninstalling the app. This deletes your personal reflections and any data stored on your device.

Anonymised organisational insights already generated will remain available to employers for long-term wellbeing analysis.


11. Changes to These Terms

We may update these Terms from time to time. If changes are significant, we will notify you in-app. Continued use of MOOD.ai after updates constitutes acceptance.


12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Disputes will be handled under Australian jurisdiction.
